Understanding our company policy 

Limited Liability and Final Sale Agreement

Effective Date: June 22 2022

This Agreement is entered into by and between Spring Home Repairs a LLC (hereinafter referred to as "the Company") and the Customer h(ereinafter referred to as "the Client") engaging in services or purchasing goods from the Company.

1. Limitation of Liability

The Client acknowledges and agrees that Spring Home Repairs LLC shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from:

Any unforeseen issues or circumstances that may arise during or after the provision of services or sale of goods.

Damage to property (including the Client's home, fixtures, or possessions) that is not a direct result of the Company's gross negligence or willful misconduct. This includes pre-existing conditions, latent defects, or issues arising from the inherent nature of materials.

Delays, interruptions, or cancellations of services due to events beyond the Company's reasonable control, including but not limited to, acts of God, extreme weather, strikes, labor disputes, material shortages, or governmental actions.

The Client agrees to inspect all work and/or goods immediately upon completion or delivery and report any issues within 48 hours. Failure to report within this timeframe will be deemed acceptance of the condition of the work and/or goods.

2. Finality of Transactions

All sales and transactions with Spring Home Repairs LLC are FINAL.

No Refunds: Unless expressly stated otherwise in a separate, written, and signed agreement, the Company maintains a strict no refund policy for all services rendered, deposits paid, and goods purchased.

No Returns or Exchanges: Goods sold are not eligible for return or exchange unless they are found to be defective prior to installation or use, and such defect is reported within the 48-hour inspection period mentioned above. In such cases, the Company’s liability shall be limited solely to the replacement of the defective goods.

Cancellation: Any deposits or payments made for services or goods are non-refundable upon cancellation by the Client.

3. Indemnification

The Client agrees to indemnify, defend, and hold harmless Spring Home Repairs LLC, its officers, directors, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or related to the Client’s breach of this Agreement or the Client’s use of the Company’s goods or services.

By engaging Spring Home Repairs LLC for services or purchasing goods from the Company, the Client acknowledges that they have read, understood, and agree to be bound by all the terms and conditions set forth in this Limited Liability and Final Sale Agreement.
